An Occupational Disease is a disease that has been contracted as a result of the work performed as an employee or on a self-employed basis in the activities specified in the chart on Occupational Diseases.
Table of Occupational Diseases
The Royal Decree 1299/2006, of 10 November, approves the table of occupational diseases contained in Annex 1 of the regulation. It contains six groups of Occupational Diseases according to cause:
- Group 1: Caused by chemical agents.
- Group 2: Caused by physical agents.
- Group 3: Caused by biological agents.
- Group 4: Caused by inhalation of substances and agents not included in other sections.
- Group 5: Of the skin, caused by substances and agents not included in any other section.
- Group 6: Caused by carcinogenic agents.
- Medical/surgical and rehabilitative treatment of injuries or diseases suffered, pharmaceutical prescriptions and, in general, all diagnostic and therapeutic techniques considered necessary by physicians caring for the injured party.
- Provision and normal renewal of required prosthetic and orthopedic devices and vehicles for invalids (wheelchairs, etc.).
- Appropriate plastic and reconstructive surgery when there are deformations or mutilations that significantly alter the physical appearance of the victim or hinder functional recovery for later employment.
- Rehabilitation treatment required to achieve more complete healing and a greater ability to work in the shortest time possible.
- Expenses incurred in travel to receive care in normal means of transport or in duly authorised extraordinary means of transport.
The benefits that FREMAP will organise, after the work-related accident or occupational disease has occurred, are regulated in the consolidated text of the General Social Security Act, approved by the Spanish Royal Legislative Decree 8/2015, of 30 October (B.O.E. [Official Government Gazette] 31/10/15), and concordant regulations:
- Temporary disability.- 75% of the regulatory base.
- Not disabling permanent injuries.- Lump sum, according to scale.
- Partial permanent disability.- 24 monthly payments of the regulatory base.
- Total permanent disability.- Pension equivalent to 55% of the regulatory base plus 20% for people over 55 years old that fulfill certain legal requirements.
- Absolute permanent disability.- Pension equivalent to 100% of the regulatory base.
- Severe disability.- Pension equivalent to 100% of the regulatory base, plus an additional 45% of the minimum contribution base and 30% of the last contribution base of the worker.
- Benefits derived from death:
- Death grant.- €46.04
- Widowhood.- pension of 52% and lump sum indemnity of 6 monthly payments of the regulatory base.
- Orphanhood.- pension of 20% and lump sum indemnity of 1 monthly payment of the regulatory base for each orphan.
- Benefits for family members.- pensions, temporary subsidies and lump sum indemnities when they have lived with and depended economically on the deceased and meet the specific requirements.
- Payment of pharmaceutical costs.
- Payment of hospital or doctor costs when these services have been used in cases of emergency.
Payment of travelling expenses to the medical services of FREMAP
(BOE-A-2006-22169).
The FREMAP Special Benefits Committee can give ex gratia economic assistance in view of states and situations of need that arise as a result of a work-related accident or occupational disease.
It can be requested by all the workers of our mutual insurance companies, or self-employed workers, that have suffered a Work-Related Accident or Occupational Disease who, as a consequence, are in a situation of economic need due to loss of income or special costs not covered by the Social Security System.
In the event of death, the employee's/worker's dependents may apply for it.
